Xiamen Land Administration Land Administration Regulations According to the regulations of the Land Administration Law of the People's Republic of China, land belongs to the state and the collectives and enterprises can legally acquire land use rights. Foreign-funded enterprises shall apply for land use in accordance with the relevant procedures and pay the corresponding land fees as required. To get the right to use industrial land, generally the development cost is charged for US $ 20-40 per square metre, depending on the yearly published standard by the municipal government, and a yearly land use fees shall be paid, ranging from 1-5 yuan per square metre according to different purposes and locations of the land. For land of the purposes of commodity housing, commerce and tourism, etc., the land use rights shall be assigned on payment in principle; the prices are subject to the changes on the market. The followings are the maximum duration for the land use rights:
An application for the extension of the duration can be filed before its expiration if the operation needs to be continued. All the land acquired through assignment on payment can lawfully be transferred, leased, mortgaged, but within the approved duration and purpose of use; registration for the divided transfer shall then be undertaken and some fees about 6% of the transaction value be paid.
